Privacy Policy
How Geekwa Pty Ltd handles personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
1. Who we are
This policy applies to Geekwa Pty Ltd (ABN 90 699 858 109, ACN 699 858 109), an Australian proprietary company registered in Western Australia and operating from Perth's northern suburbs in the 6065 postcode. In this policy, “we”, “us” and “our” mean Geekwa Pty Ltd.
We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in that Act.
2. What this policy covers
This policy explains what personal information we collect, why we collect it, how we use, store and disclose it, and how you can access it, correct it or complain about how we have handled it. It applies to the geekwatec.site website and to the IT services we provide to clients.
Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not it is true and whether or not it is recorded in a material form.
3. The personal information we collect
We only collect personal information that is reasonably necessary for our functions and activities as an IT services provider. Depending on your dealings with us, this may include:
- your name and the name of the organisation you represent;
- your email address and, if you provide one, a contact number;
- the suburb or address where equipment is located, so we can attend on site;
- details of the fault, device, network or system you have asked us to work on;
- records of our correspondence with you, including quotes and job notes; and
- billing and payment records relating to work we have performed.
Information encountered while servicing your equipment
Repair, data recovery and support work can involve access to devices, accounts and storage media that contain personal information belonging to you or to third parties, including your own customers or family members. We access such information only to the extent required to perform the work you have engaged us to do, we do not copy or retain it beyond what that work requires, and we do not use it for any other purpose.
Sensitive information
We do not seek sensitive information as defined in the Privacy Act 1988. If sensitive information happens to be present on equipment we service, it is treated with the same restriction described above.
4. How we collect personal information
Wherever it is reasonable and practicable, we collect personal information directly from you — when you email us, submit an enquiry through this website, speak with us about a job, or provide details while work is under way. We may also collect information from a person who refers you to us, or from a colleague or family member who arranges a job on your behalf.
5. Why we collect, hold and use it
We collect, hold and use personal information to:
- respond to your enquiry and provide a diagnosis and quotation;
- perform the repair, support, network, backup or security work you have engaged us for;
- contact you about a job in progress and about work we have previously carried out;
- invoice you and maintain our financial and tax records; and
- meet our obligations under Australian law.
We do not sell personal information, and we do not use it to send marketing material you have not asked for.
6. This website, cookies and server logs
The geekwatec.site website is a static site. It does not set tracking or advertising cookies, it does not run third-party analytics, and it does not contain tracking pixels or social media trackers.
The enquiry form on our contact page does not transmit anything to a server. It opens a message in your own email application, addressed to us, which you choose whether to send.
Our hosting provider may automatically record standard technical information when a page is requested, such as an IP address, the time of the request, the page requested and the type of browser used. This is generated by the hosting infrastructure for security and reliability purposes and is not used by us to identify individual visitors.
7. When we disclose personal information
We do not disclose personal information except where it is necessary for the purpose it was collected, or where the law requires or authorises us to. That may include disclosure to:
- a specialist supplier where a task falls outside what we can perform ourselves, such as a physical data recovery laboratory, and then only with your agreement;
- a supplier of parts or a manufacturer, where a warranty claim requires the device details;
- our accountant or other professional advisers, under obligations of confidentiality; and
- a court, tribunal, regulator or law enforcement body where we are legally required to do so.
8. Overseas disclosure
We are an Australian business and we hold your information in Australia wherever we practicably can. Some of the everyday business software we use, such as email and cloud storage, is operated by providers who may store data on servers located outside Australia. Where that occurs, we take reasonable steps to satisfy ourselves that the provider handles the information in a way consistent with the Australian Privacy Principles.
9. How we store and protect information
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. Those steps include access controls and multi-factor authentication on the accounts we use, encryption on our own devices and storage media, secure disposal or destruction of records we no longer need, and limiting access to job information to those who need it to do the work.
No method of transmission or storage is completely secure. While we work to protect the information we hold, we cannot guarantee absolute security, and information sent to us by email travels over networks we do not control.
10. How long we keep it
We keep personal information only for as long as we need it for the purpose it was collected, or for as long as we are required to keep it by law — financial records, for example, must be retained for the period required by Australian taxation law. Data recovered on your behalf is returned to you and removed from our equipment once you have confirmed you have it. When information is no longer needed and we are not required to retain it, we destroy it or de-identify it.
11. Accessing and correcting your information
Under APP 12 and APP 13 you may ask us for access to the personal information we hold about you, and you may ask us to correct it if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading. Write to us at [email protected] and we will respond within a reasonable period.
We may need to verify your identity before releasing information. If we refuse a request for access or correction, we will tell you why in writing and explain how you can complain about that decision. We do not charge for making a request, though we may charge a reasonable cost for supplying access in some circumstances.
12. Making a complaint
If you believe we have breached the Australian Privacy Principles or otherwise mishandled your personal information, please tell us first. Email the details to [email protected] with “Privacy complaint” in the subject line. We will acknowledge your complaint, investigate it, and write to you with the outcome and our reasons.
If you are not satisfied with our response, you may refer the matter to the Office of the Australian Information Commissioner (OAIC), which oversees compliance with the Privacy Act 1988 and can be contacted through its published enquiry channels.
13. Notifiable data breaches
If we become aware of unauthorised access to, or disclosure or loss of, personal information we hold, and that is likely to result in serious harm to the individuals affected, we will assess the incident and notify those individuals and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme under the Privacy Act 1988.
14. Changes to this policy
We may update this policy from time to time to reflect changes in our practices or in the law. The current version is always the one published on this page, and the date at the top shows when it was last revised.
